Terms of Use
The terms that govern your use of the HospitAlert app and website. See also our Privacy Policy.
These Terms of Use ("Terms") are an agreement between you and HospitAlert LLC ("HospitAlert," "we," "us") and govern your use of the HospitAlert app and hospitalert.com (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. Section 13 contains an arbitration agreement and class-action waiver.
1. Eligibility
HospitAlert can be used by adults and by children whose parent or legal guardian sets it up for them.
Adults. If you are 18 or older, you can set up HospitAlert for yourself, or for another adult who has given you permission and for whom you have authority to act.
Children under 18. A parent or legal guardian can set up HospitAlert on their child's phone. When you do, you confirm that you are the child's parent or legal guardian, you accept these Terms on your child's behalf, and you are responsible for your child's use of the Service.
2. What the Service does
HospitAlert uses your device's location to detect when you arrive at a hospital or emergency room, prompts you to confirm or dismiss, and, if you don't respond within the window you set, notifies the emergency contacts you chose. Features vary by plan and may be limited or unavailable in some states or locations.
3. Not medical advice; no guarantee of alerts
The Service does not provide medical advice, diagnosis, or treatment, and does not create a provider relationship with anyone. We do not monitor alerts in real time and do not guarantee that any alert will be sent, delivered, received, or acted on. Facility data comes from public and third-party sources and may be incomplete or out of date. You are responsible for keeping location permissions on, your app updated, and your contacts' details correct.
4. Your account
Provide accurate information and keep your login secure. You are responsible for activity on your account. Tell us promptly at admin@hospitalert.com if you suspect unauthorized use.
5. Emergency contacts and text messages
Adding someone as a contact means you confirm you have their permission to share their phone number with us. Texting them an invitation is a separate, optional step: nothing is sent unless you tap "Send Invite" and then confirm in the app that they are happy to receive it. Each confirmed invitation sends one text, and you can resend it later if needed. Alerts are delivered as notifications in the app, only to contacts who have accepted. Contacts must accept before they receive alerts. A contact can remove themselves at any time in the app, which also blocks the person who added them from adding them again. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of text messages at any time, or HELP for help. Support: admin@hospitalert.com.
6. Medical information you add
Anything in your medical card is optional and is shared only with your contacts when an alert is sent. You are responsible for its accuracy. Do not rely on HospitAlert as a medical record.
7. Subscriptions and payment
Some features require a paid subscription. Subscriptions purchased through the Apple App Store or Google Play are billed and managed by that store under its terms, renew automatically until canceled, and must be canceled in your store account settings at least 24 hours before renewal. Subscriptions purchased on our website are processed by Stripe and can be canceled in the app. Prices may change with advance notice. Except where required by law or store policy, payments are non-refundable; refunds for store purchases are handled by Apple or Google.
8. Acceptable use
You agree not to: use the Service to track, monitor, or locate anyone without their knowledge and consent (for a child under 18, the consent of their parent or legal guardian); add contacts who haven't agreed to it; send false alerts to harass or alarm people; reverse-engineer, scrape, or interfere with the Service; or use it for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.
9. Our intellectual property
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial use under these Terms. HospitAlert, its logo, and the Service are owned by HospitAlert LLC. Feedback you send us may be used without obligation to you.
10. Termination
You can stop using the Service and delete your account at any time in Settings. We may suspend or end your access if you violate these Terms or if we discontinue the Service, with notice where practical. Sections 3 and 11–15 survive termination.
11. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, HospitAlert disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, timely, accurate, or error-free, or that any alert will be sent or received.
12. Limitation of liability
To the fullest extent permitted by law, HospitAlert and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any harm arising from a delayed, missed, or erroneous alert. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.
Some jurisdictions do not allow these limits, so they may not apply to you in full. Nothing in these Terms limits liability that cannot be limited by law.
Indemnity. You agree to defend and indemnify HospitAlert against claims arising from your misuse of the Service or your violation of these Terms or of anyone's rights, including adding contacts without permission.
13. Disputes, arbitration, and class-action waiver
Please contact us first at admin@hospitalert.com; most issues can be resolved informally within 60 days. If not, you and HospitAlert agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association under its Consumer Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and HospitAlert waive the right to a jury trial and to participate in any class or representative action. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any court proceeding permitted under these Terms will take place in Los Angeles County, California.
15. Apple App Store terms
If you downloaded the app from the Apple App Store: (a) these Terms are between you and HospitAlert, not Apple, and HospitAlert — not Apple — is solely responsible for the app and its content; (b) your license is limited to use on Apple-branded products you own or control, as permitted by the App Store Usage Rules; (c) Apple has no obligation to provide maintenance or support; (d) if the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation; (e) HospitAlert, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal-compliance, consumer-protection, and privacy claims; (f) HospitAlert, not Apple, is responsible for any third-party claim that the app infringes intellectual property; (g) you represent you are not located in a country subject to a U.S. embargo or on a U.S. prohibited-parties list; and (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes and general terms
We may update these Terms and will post the new version here, with notice in the app or by email for material changes. Continued use after changes take effect means you accept them. If any provision is unenforceable, the rest stays in effect. These Terms and the Privacy Policy are the entire agreement between us about the Service. You may not assign these Terms; we may assign them in connection with a merger or sale.
